Beijing Municipal People’s Congress

  

Beijing Municipal People’s Congress (BMPC) is the organ of state power of Beijing Mucipality.


Deputies to the BMPC are elected for a five-year term with at least one annual meeting convened by the Standing Committee of BMPC. Interim meetings may be held if considered necessary by the Standing Committee or proposed by over 1/5 of the deputies. The meetings shall be attended by over 2/3 of the deputies.


BMPC exercises the following functions and powers:


To formulate and promulgate local laws and regulations under the precondition of not  contravening the Constitution, laws and administrative rules and regulations in accordance with the practical conditions and actual needs of the municipality, and submit them to the Standing Committee of NPC and the State Council for the record.


To ensure the observance and enforcement of the Constitution, laws, administrative rules and regulations and resolutions made by NPC and its Standing Committee as well as the implementation of national plans and state budgets within the administrative area..


To review and approve the municipality’s national economic and social development plans and budgets as well as relevant implementation reports.


To discuss and decide major matters of the municipality concerning politics, economy, education, science, culture, health, environment and resource protection, civil administration and ethnic groups, etc..


To elect Chairman, Vice Chairmen, Secretary-general and Members of the Standing Committee of BMPC, Mayor and Vice Mayor of the People’s Government of Beijing Municipality, President of Beijing High People’s Court and Chief Procurator of Beijing People’s Procuratorate and the municipality’s deputies to NPC; the decision on the Chief Procurator should be reported to the Chief Procurator of Supreme People’s Procuratorate and submitted to the Standing Committee of NPC for approval.


To decide whether to accept the resignation of Members of the Standing Committee of BMPC, leading Members of the People’s Government of Beijing Municipality, President of Beijing High People’s Court and Chief Procurator of Beijing People’s Procuratorate.


To dismiss the Members of the Standing Committee of BMPC, Members of the People’s Government of Beijing Municipality, President of the Beijing High People’s Court, Chief Procurator of the Beijing People’s Procutorate and municipality’s deputies to the NPC; the decision on dismissing the chief procurator shall be reported to the Chief Procurator of Supreme People’s Procuratorate and submitted to the Standing Committee of NPC for approval.


To hear and review the report on the work of the Standing Committee of BMPC; to hear and review the reports on the work of the People’s Government of Beijing Municipality, Beijing High People’s Court and Beijing People’s Procutorate.

 
To alternate or revoke the inappropriate resolutions of the Standing Committee of BMPC; to revoke the inappropriate decisions and orders of the People’s Government of Beijing Municipality; to protect the property owned by the people and the property collectively owned by the working people; to protect the legitimate private property owned by the citizens and the personal rights, democratic rights and other legitimate rights of the citizens; to keep the society in order; to protect the legitimate interests of economic organizations; to protect the rights of the minority groups; to guarantee gender equality, equal pay for equal work, free marriage and other rights of women stipulated in the Constitution and laws.

  

The Standing Committee of Beijing Municipal People’s Congress

   

The Standing Committee of Beijing Municipal People’s Congress (BMPC) is the permanent body of the BMPC; it is responsible to and reports to the BMPC on its work.
The Standing Committee of BMPC is composed of Chairman, Vice Chairmen, Secretary-General and other members. They are all elected by the BMPC from among its deputies for the same term as BMPC. None on the Standing Committee of BMPC shall hold office in any of the administrative, judicial or procuratorial organs of the state.
The Standing Committee of BMPC meets at least once every two month and the meetings are convened by the Chairman. A simple majority of all Standing Committee members is required to pass the decisions made by the Standing Committee of BMPC.
The Standing Committee of BMPC exercises the following functions and powers:
To ensure the observance and enforcement of the Constitution, laws, administrative rules and regulations, and the resolutions made by the NPC and its Standing Committee within the administrative area;
To formulate and promulgate local laws and regulations when the BMPC is not in session under the precondition of not contravening the Constitution, laws and administrative rules and regulations in accordance with the municipality’s practical conditions and actual needs, and submit them to the Standing Committee of NPC and the State Council for the record;
To discuss and decide on major matters of the municipality concerning politics, economy, education, science, culture, public health, environment and resource protection, civil administration and ethnic groups; to decide to make partial alternations in the municipality’s plans for national economic and social development and budgets; to decide on the major issues submitted by the Chief Procurator of the Beijing People’s Procuratorate for discussion; and to decide on granting local honorary titles.
To oversee the work of the People’s Government of Beijing Municipality, the Beijing High People’s Court and the Beijing People’s Procuratorate; to revoke the inappropriate resolutions of the district and county People’s Congress and their Standing Committees; to repeal the inappropriate decisions and orders of the People’s Government of Beijing Municipality; and to handle the complaints and opinions from people to the national organs of Beijing and their staff.
To appoint or dismiss individual Vice Mayors when the BMPC is not in session; to decide the individuals acting on behalf of the mayor, the president of Beijing High People’s Court and the chief procurator when they cannot take on duties for some reasons; to appoint or dismiss government members, judges of Beijing High People’s Court and Beijing People’s Procuratorate; to decide and dismiss individual Vice Mayors when the BMPC is not in session; to decide and dismiss government members, judges of the Municipal People’s Court and procurators of the Beijing People’s Procuratorate appointed by the dismissed deputy mayors; and to dismiss individual deputies of the NPC and replace the vacancies.
The Chairman of the Standing Committee of BMPC, Vice Chairmen and Secretary-General convene chairmen meeting to undertake major routine work of the Standing Committee of BMPC.
The Deputy Credentials Committee of the Standing Committee of BMPC reviews deputies’ qualification. The Chairman, Vice Chairmen and Members of the Review Committee are nominated from among the Members of the Standing Committee of BMPC and passed at its meeting. The Review Committee reviews whether the election is in accordance with the laws and regulations.
